The Foreign Marriage Act of 1969 was enacted to provide a legal framework for the solemnization of marriages by Indian citizens outside India. This Act ensures that such marriages are recognized under Indian law, provided they meet specific criteria.

Key Provisions of the Foreign Marriage Act, 1969:

  1. Appointment of Marriage Officers: The Central Government appoints diplomatic or consular officers as Marriage Officers in foreign countries to facilitate the solemnization of marriages under this Act.

     

     

  2. Conditions for a Valid Marriage: For a marriage to be valid under this Act:

    • Neither party should have a living spouse.
    • Both parties must be of sound mind.
    • The bridegroom must be at least 21 years old, and the bride at least 18 years old.
    • The parties should not be within the degrees of prohibited relationship, unless permitted by their personal laws or customs.
  3. Notice of Intended Marriage: Parties intending to marry must give written notice to the Marriage Officer in the prescribed form, stating that at least one party has resided in the district of the Marriage Officer for a minimum of 30 days preceding the notice.

     

  4. Publication of Notice and Objections: The Marriage Officer records the notice in the Marriage Notice Book, which is open for public inspection. If there are objections to the marriage within 30 days of publication, the Marriage Officer investigates. If the objection is valid, the marriage cannot proceed until resolved.

     

     

  5. Solemnization of Marriage: Marriages are solemnized in the presence of the Marriage Officer and three witnesses. The ceremony can be conducted in any form chosen by the parties, provided it includes the necessary legal declarations.

     

  6. Registration of Foreign Marriages: Marriages solemnized under local laws in foreign countries can be registered under this Act if one party is an Indian citizen and the marriage meets the Act's conditions. The Marriage Officer may refuse registration if the marriage is inconsistent with international law or the comity of nations.
