Conditions for a Valid Marriage: For a marriage to be valid under this Act:
Notice of Intended Marriage: Parties intending to marry must give written notice to the Marriage Officer in the prescribed form, stating that at least one party has resided in the district of the Marriage Officer for a minimum of 30 days preceding the notice.
Publication of Notice and Objections: The Marriage Officer records the notice in the Marriage Notice Book, which is open for public inspection. If there are objections to the marriage within 30 days of publication, the Marriage Officer investigates. If the objection is valid, the marriage cannot proceed until resolved.
Solemnization of Marriage: Marriages are solemnized in the presence of the Marriage Officer and three witnesses. The ceremony can be conducted in any form chosen by the parties, provided it includes the necessary legal declarations.
Registration of Foreign Marriages: Marriages solemnized under local laws in foreign countries can be registered under this Act if one party is an Indian citizen and the marriage meets the Act's conditions. The Marriage Officer may refuse registration if the marriage is inconsistent with international law or the comity of nations.
