Key Provisions

1. Scope

• Applicable for acquisitions by Government, PPP projects, and private companies.

• Covers public purposes like infrastructure, housing, defense, industry, etc.

2. Consent Clause

• 80% consent required for private projects.

• 70% consent required for PPP projects.

3. Compensation

• Rural Areas – Up to 4 times market value.

• Urban Areas – Up to 2 times market value.

• Includes land value, assets, and livelihood loss.

4. Rehabilitation & Resettlement (R&R)

• Mandatory R&R package includes:

  • Housing, annuities, or employment.

  • Infrastructure in resettlement areas.

  • Special provisions for SCs/STs.

5. Social Impact Assessment (SIA)

• Compulsory SIA before acquisition.

• Public hearings and Gram Sabha consultations.

• Evaluates effects on livelihoods, environment, and communities.

6. Return of Unused Land

• Land unused within 5 years must be returned to owners or land banks.

7. Food Security Safeguards

• Restricts acquisition of multi-crop irrigated land to exceptional cases.

8. Transparency & Accountability

• Mandatory publication of acquisition details.

• Grievance redressal through Land Acquisition, Rehabilitation, and Resettlement Authority.
